Waiver, Release of Liability & Assumption of Risk

I understand that participation in the Activities involves inherent and significant risks, including but not limited to: slipping or falling; drowning; rough seas; wakes and currents; collisions with vessels, objects, or people; boarding and disembarking; equipment failure; weather conditions (including lightning, heat, and sun exposure); marine life encounters; and the actions of myself or others, including intoxicated participants.

I knowingly and voluntarily assume all risks, both known and unknown, even if arising from the negligence of the Company.

I agree to:

• Follow all instructions from the captain and crew at all times (captain has final authority)
• Act responsibly and not endanger myself or others
• Use equipment safely
• Wear required safety gear when instructed (including flotation devices while underway)

I understand that unsafe behavior, including excessive alcohol use, may result in immediate termination of my participation without refund.

I certify that I am physically and mentally fit to participate and have no condition (including pregnancy, heart, orthopedic, or respiratory issues) that would be worsened by participation. I will not participate while impaired by drugs, alcohol, or medication.

I understand that medical assistance may be delayed due to location. I authorize the Company to obtain emergency medical care on my behalf if necessary and agree to be financially responsible for all costs.

To the fullest extent allowed by Florida law, I release, waive, and discharge the Company and its owners, employees, crew, agents, and affiliates (“Released Parties”) from any and all claims for injury, death, property damage, or loss arising out of or related to my participation in the Activities, INCLUDING CLAIMS ARISING FROM NEGLIGENCE of the Released Parties.

I agree to indemnify and hold harmless the Released Parties from any claims, damages, liabilities, or expenses (including attorneys’ fees) arising from my actions or participation.

I accept full responsibility for any damage I cause to property or injury to others and agree to indemnify the Company for such claims.

I understand that routes, destinations, and activities may change due to weather, mechanical issues, or safety concerns at the captain’s discretion.

I grant permission for the Company to use my image or likeness for lawful promotional purposes without compensation.

• This agreement is governed by Florida law
• Venue for any legal action shall be Manatee County, Florida
• If any provision is found unenforceable, the remainder shall remain in full force

By signing, I confirm that:

• I have read and understand this agreement
• I am voluntarily giving up substantial legal rights, including the right to sue
• I intend this to be a complete and unconditional release of liability
